Notice of Proposed Rules

The Office for Oregon Health Policy and Research shall issue any rules related to ORS 414.021 and 414.024, 414.751, 442.011 through 442.120, 442.400 through 442.469, and 653.845. Prior to the adoption, amendment, or repeal of any permanent rule, the Office for Oregon Health Policy and Research shall give notice of the intended action:

(1) In the Secretary of State's bulletin referred to in ORS 183.360 at least 21 days prior to the effective date of the intended action.

(2) By mailing a copy of the notice to persons on the Office for Oregon Health Policy and Research's mailing list established pursuant to ORS 183.335(7) at least 28 days before the effective date of the rule.

(3) By mailing or furnishing a copy of the notice at least 28 days before the effective date of the rule to:

(a) Associated Press;

(b) Oregon Association of Hospitals and Health Systems;

(c) Oregon Health Care Association;

(d) Oregon Medical Association;

(e) Oregon Association of Homes for the Aging;

(f) Capitol Building Press Room;

(g) The section(s) of the Health Division responsible for administering the certificate of need program and health facility construction plans review program; and

(h) The legislators specified in ORS 183.335(14).

Model Rules of Procedure

The Office for Oregon Health Policy and Research adopts by reference the Attorney General's Uniform and Model Rules of Procedure in effect as of January 1, 2002, except where these rules conflict with rules adopted in OAR Chapter 409.
